iMpatient — Terms & Conditions

1. Agreement

These Terms & Conditions ("Terms") are a contract between you and SymbAIo Inc., a Delaware (USA) corporation ("iMpatient", "we", "us"), governing your use of the iMpatient™ app and website (the "Service"). By creating an account or using the Service, you agree to these Terms. If you don't agree, don't use the Service.

2. What iMpatient is — and is not

iMpatient is a productivity application that organizes patterns across your personal life, work, and health and returns them to you as foresight, to help you plan and get a little of your time back.

iMpatient is not a medical device, health-care provider, or diagnostic service. It does not provide medical, psychological, legal, or financial advice, and its outputs are not a substitute for professional judgment. Always consult a qualified professional for decisions about your health or other important matters. If you may be experiencing a medical emergency, contact your local emergency services.

3. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. By creating an account, you confirm that you meet this requirement.

4. Your account

You're responsible for the accuracy of your account information, for keeping your credentials secure, and for activity under your account. Notify us at support@symbaio.io of any unauthorized use.

5. Connected services

You may choose to connect third-party services (such as Withings, calendars, and other wearables on our roadmap). Your use of those services is governed by their own terms, and you authorize iMpatient to read the data you approve. You can disconnect at any time. We are not responsible for third-party services.

6. Alph.read™ and AI-generated content

The Service includes Alph.read™, an assistant that generates responses using third-party AI (the Anthropic Claude API). AI outputs may be inaccurate or incomplete and are provided for informational and organizational purposes only. Do not rely on them as professional advice. You are responsible for how you act on the Service's outputs.

7. Subscriptions and billing

iMpatient offers three tiers — Free, Essential, and Pro — that reflect how much of your patterns you'd like to see, not a feature wall. Current pricing for paid tiers is shown in the app and on the relevant app store. Paid tiers are billed through the applicable app store (Apple App Store, Google Play) under that store's terms; manage or cancel through your store account. Subscriptions renew automatically unless cancelled before the end of the current period. Refunds are handled under Apple's or Google's policies, as applicable.

8. Acceptable use

You agree not to: misuse or disrupt the Service; attempt to access it unlawfully; reverse engineer except as permitted by law; upload unlawful or infringing content; or use the Service to harm others.

9. Intellectual property

The Service, including the iMpatient™ and Alph.read™ names and related marks, is owned by SymbAIo Inc. and protected by law. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal use. You retain rights to the content you submit and grant us a license to process it solely to provide the Service to you.

10. Privacy

Our Privacy Policy explains how we handle your information and is incorporated into these Terms. Our use of cookies is described in our Cookies Policy.

11. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access for breach of these Terms or to protect the Service or other users. Sections that by nature should survive termination (e.g. IP, disclaimers, limitation of liability) survive.

12. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that its outputs are accurate. Nothing in these Terms excludes rights you have under the Australian Consumer Law or other mandatory consumer protections that cannot lawfully be excluded.

13. Limitation of liability

To the maximum extent permitted by law, iMpatient and its affiliates are not liable for indirect, incidental, special, consequential, or exemplary damages, or for any decisions you make based on the Service. Where liability cannot be excluded but can lawfully be limited, our total liability for any claim arising out of or relating to the Service is limited to the greater of (a) USD 100 or (b) the amount you paid us for the Service in the twelve (12) months preceding the event giving rise to the claim. For Australian consumers, this limitation does not exclude or limit the re-supply or refund remedies required by the Australian Consumer Law where those remedies apply.

14. Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules, and you submit to the courts located in Delaware. This does not limit any mandatory consumer rights you have in your own location — including, for Australian users, rights under the Australian Consumer Law that cannot lawfully be excluded.

15. Changes

We may update these Terms; we'll post changes here and update the date, and notify you of material changes. Continued use after changes means you accept them.
